Terms of Service

1. Who we are
prevailofficial.com (the "Store") is operated by Prevail Official LLC, a Wyoming (USA) limited liability company ("Prevail", "we", "us"). Contact: ceo@prevailofficial.com.

2. Agreeing to these Terms
By using the Store or placing an order, you agree to these Terms. Our Refund policy, Shipping policy and Privacy policy (linked in the Store footer) form part of these Terms. If you don't agree, please don't use the Store.

3. Eligibility
To place an order, you must be at least 18 years old (or the age of majority where you live), or have the permission of a parent or guardian. You must give accurate information when you order.

4. Products
We try to describe products, sizing and colors accurately. Screens vary, and small differences in color, print placement and measurements are normal for apparel. Please check the size guide before ordering. All products are subject to availability, and some are available in limited quantities.

5. Prices and payment
Prices are shown on each product page, in US dollars or, in some markets, in Japanese yen. Shipping, and any taxes or duties collected, are shown at checkout before you pay. Payment is taken when you place your order, using the payment methods shown at checkout. Prices can change at any time, but a change doesn't affect an order we've already confirmed, except as described in section 6.

6. Errors in prices or listings
If a price or product description is clearly wrong (for example, because of a technical or typing error), we may cancel the affected order, even after you've received a confirmation, and refund you in full. We'll let you know by email.

7. Orders
Your order is an offer to buy. We may decline or cancel an order, with a full refund, if an item is unavailable, if we suspect fraud or unauthorized use of a payment method, if an order appears to be for resale or placed using automated tools, or if we can't lawfully ship to the destination.

8. Discount codes and promotions
Discount codes and promotions have the terms shown when they're offered. Unless stated otherwise, one code per order, codes can't be combined, they have no cash value, and they can't be applied to past orders. We may end a promotion that's being misused.

9. Shipping and returns
Shipping is covered by our Shipping policy, and returns and refunds by our Refund policy.

10. Intellectual property
All content on the Store, including designs, graphics, photos, text, logos and the PREVAIL name, belongs to Prevail or its licensors. You may not copy, reproduce, sell or create products from it without our written permission.

11. Your content
If you send us reviews or photos, or tag us on social media, and agree that we can share them, you give us a non-exclusive, royalty-free license to repost and display that content with credit. You confirm you have the right to share it. You can ask us to remove it at any time.

12. Acceptable use
Don't misuse the Store. That includes trying to get unauthorized access, interfering with its security or operation, scraping it, or using it for anything unlawful.

13. Third-party links and services
The Store may link to or use third-party services (for example payment providers, carriers and social media). We're not responsible for their content or practices.

14. Disclaimer
Except as stated in these Terms and as required by law, the Store and its content are provided "as is".

15. Limitation of liability
To the fullest extent the law allows:

• our total liability for any claim relating to an order is limited to the amount you paid for that order; and
• we aren't liable for indirect or consequential losses.

This doesn't limit liability for our intentional misconduct or gross negligence, for death or personal injury caused by our negligence, or any other liability that can't be limited by law. If you're a consumer in Japan, the EU, the UK or anywhere else where consumer law restricts these limits, they apply only as far as that law allows.

16. Governing law and disputes
These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-law rules. If you have a problem, please email us first so we can try to resolve it informally. Any dispute that isn't resolved may be brought in the state or federal courts located in Wyoming.

If you're a consumer, this doesn't take away the protection of mandatory consumer laws of the country where you live, or any right you have under those laws to bring a claim in your local courts. For customers in Japan, that includes the Consumer Contract Act and the Act on Specified Commercial Transactions.

17. Changes to these Terms
We may update these Terms from time to time. The version posted when you place an order applies to that order.

18. Language
If we provide a translation of these Terms, the English version controls, except where local law requires otherwise.

19. General
If any part of these Terms is unenforceable, the rest stays in effect. If we don't enforce a term, that isn't a waiver. These Terms, together with the policies listed in section 2, are the entire agreement between you and us about your use of the Store.
